So what happens (if anything can be done) I been married for 17 years stay at home mom. Looks like my marriage is pretty much over. And we have no assets and get this he works under the table/cash. No record’s of him having a income which he does and a very good one at that… So I’m screwed right ?
If you have no assets and you get half, that’s half of nothing. But whatever you do have belongs to both of you and should be divided between you in some way. He likely has a duty to support you under the laws of your state, which is what he’s been doing during the marriage, so figure out what he’s been spending on all of your family’s expenses, and you can assert that he must have been making at least that much, even though his tax return shows no income.
